Who We Are

For purposes of information society services regulations, the service providers are the individuals indicated below (hereinafter the "Owners"):

For any inquiries or notifications related to these Terms or the App, you can write to the above email address. For data protection matters, see the specific section indicated in the Privacy Policy.

Feedback and Suggestions

During the pilot, you may send us ideas, comments, or suggestions about the App ("Feedback"). You grant us a non-exclusive, worldwide, irrevocable, royalty-free, and sublicensable license to use, reproduce, and exploit the Feedback to improve the App and our services, without obligation to compensate you. Feedback is considered non-confidential unless we agree otherwise in writing.

Accounts, Eligibility, and Minimum Age

Eligibility

The pilot is restricted to invited Testers. Sharing accounts or credentials is not permitted. Participation requires a minimum age of fourteen (14) years. If we admit minors, verifiable consent from the person holding parental authority or legal representation must exist.

Age Verification

The Owner may request proof of age and/or consent, or reject/suspend access if not verified. You must provide accurate and updated information and safeguard your credentials. You are responsible for use made from your account/device. If you detect unauthorized access, report it immediately to orareapp@gmail.com.

Prohibitions

Do not attempt to circumvent access controls, interfere with security, reverse engineer, extract data at scale, or use the App for illicit purposes or that violate third-party rights from your account. We may suspend or cancel your access if you breach these Terms or if necessary for technical/legal reasons. We will keep minimal records to meet legal obligations or defense of claims according to the Privacy Policy.

License to Use and Intellectual Property

Ownership

The Orare App, its code, design, interfaces, texts, images, databases, logos, names, distinctive signs, and other content are owned by Owners 1 and 2 or their licensors and are protected by Spanish and EU regulations, particularly the Consolidated Text of the Intellectual Property Law (Royal Legislative Decree 1/1996), Law 17/2001 on Trademarks, Law 20/2003 on Legal Protection of Industrial Design, and Law 1/2019 on Trade Secrets. Reproduction, distribution, public communication, including making available, transformation, or any use not expressly authorized is prohibited. All rights not expressly granted are reserved.

License Granted to You

We grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the App only during the pilot, solely for testing the service and providing feedback.

• Copy, distribute, or publicly communicate the App or its contents except as permitted by law
• Reverse engineer or decompile
• Remove rights notices
• Use the App to create a competing product
• Sell, rent, sublicense, or assign the App or its access

Use contrary to these Terms may result in suspension or termination of access and, where appropriate, legal action. The "Acceptable Use" section details the testers' commitment to the app.

Notices and Risk Assumption

The App is Catholic-themed and offers spiritual and informational resources. Automatically generated results (Artificial Intelligence) do not constitute medical, psychological, legal, or professional advice. You should review them critically before use. If you need help in these matters, consult a qualified professional.

Any decision you make based on the App's content is your responsibility.

Acceptable Use

To preserve a safe environment during the pilot, you commit to:

• Comply with the law and these Terms; do not use the App for illicit purposes or violate third-party rights
• Respect people: no harassment, threats, hate speech, discrimination, violence, or sexually explicit content or that affects minors
• Do not violate intellectual/industrial property, image, or privacy rights
• Do not interfere with the security or availability of the service: no reverse engineering outside legal cases, scraping, spamming, malware, load testing, massive data extraction, or attempts to circumvent technical controls
• Do not impersonate identities or falsify your age or data
• Do not post unlawful, defamatory content or that incites hatred or violates privacy rights or that infringes these Terms
• Data minimization: avoid entering unnecessary or especially sensitive personal data into the App
• Cookies/SDKs: do not manipulate the consent manager or cookie/SDK preferences

If you detect potentially unlawful content or activity, write to us at orareapp@gmail.com providing as much information as possible. We will address notices within a reasonable time.

Suspension and Termination

By Us

We may suspend or terminate your access totally or partially if: (i) you breach these Terms; (ii) it is necessary for security, technical, or legal reasons; (iii) the pilot ends; or (iv) there are indications of illegality or abusive use. When reasonable, we will notify you in advance.

By You

You can stop using the App at any time. If you wish to close your account and/or exercise rights over your data, follow the App's instructions or write to us at orareapp@gmail.com.

Effects of Termination

Upon termination, your license to use is revoked and access is canceled. We may keep minimal information during legally necessary periods to meet legal obligations and defense of claims, according to the Privacy Policy. Clauses relating to intellectual property, liability limitations, privacy, applicable law, and dispute resolution will remain in effect, as well as any others that by their nature should remain after termination.

Participation in the pilot is by invitation; readmission is at our discretion.

Limitation of Liability

Liability Limits

To the extent permitted by law, the Owner will not be liable for indirect, incidental, special, exemplary, or consequential damages (including loss of data, reputation, revenue, or anticipated savings) arising from use or inability to use the App. In any case, the Owner's total cumulative liability to you for claims related to the App during the pilot will be limited to (i) zero (0) €, or (ii) the amount you may have paid to use the App in the three (3) months prior to the event that gave rise to the claim. In the pilot there are no payments, so this limit is set at zero (0) €.

No Exclusion of Mandatory Liability

None of the above excludes liability in cases where it cannot be limited by law, so your legal rights as a user are not affected.

Applicable Law and Dispute Resolution

Applicable Law

These Terms are governed by Spanish law.

Jurisdiction

Unless otherwise mandated by law, the parties submit to the Courts and Tribunals of Barcelona, province of Catalonia, with express waiver of any other jurisdiction that might correspond. Before going to court, we will attempt an amicable solution by contacting orareapp@gmail.com.
